Terms and Conditions

At Blue Ladder we pride ourselves on delivering a fair and transparent service to all our clients.

This starts with a  clear set of terms and conditions (“T&Cs”)  to ensure you, and our team, know exactly what to expect before working together. When you accept a quotation from us it means you also accept these T&Cs.

We’ve cut out as much legal jargon as possible. But if anything is unclear feel free to contact us. We’re always on hand to help with any questions.

Please note we have a separate privacy and cookie policies, covering the use of our website. The terms below apply to our building work.

1. Definitions

1.1 Contractor: that’s us, Blue Ladder (“Us”, “We” or “Blue Ladder” in these T&Cs).

1.2 Client: that’s you (“You” or “Client” in these T&Cs).

1.3 Quotation: this is a formal offer made to you by Blue Ladder, via the online portal. It includes a cost breakdown, timelines and scope of work, tailored to your specific requirements. These T&Cs will be applied to your quotation.

1.4 Scope of work (”the work”)  the building services you request Blue Ladder to carry out.

2. Quotation

2.1 You’ll get one fixed price that covers everything – no hidden costs. From labour to materials, it’s all included. The only time we’d need to apply extra charges is if any of these exceptional circumstances apply:

2.1.1 If carrying out the work reveals any previously unseen damage, weakness, lack of structural integrity, or other issue that must be resolved or repaired so that the work can be completed.

2.1.2 If carrying out the work reveals any unsafe area, appliance, structure, etc. that must be repaired or made right, in order for the work to continue safely.

2.1.3 If any materials you source or order are delayed, or Blue Ladder needs to do extra work to source missing items.

2.2 Your quotation will include a detailed scope of work. This lays out exactly what services we’ll be providing. It will also include project timelines.

2.3 Once we send you an online quotation the terms of this offer are effective for up to 30 days. If you don’t accept the quote within the 30 days, the offer might be subject to changes by Blue Ladder. But don’t worry. We’ll be sure to let you know what edits are made, if any.

2.4 When you accept a quotation from us, you agree to these T&Cs.

3. Payment terms

3.1 You can pay online via the customer portal, in cash or by bank transfer. Whichever is easiest for you.

3.2 Before work begins, we’ll normally ask you for a 50% deposit. The deposit amount may be greater or lesser than 50% of the total cost, depending on the specifics of your project, for example, if we need to order a large amount of non-refundable materials. The remaining balance is payable immediately after work is completed to your satisfaction. Your quotation will include all payment details and schedules. So you know what to expect before committing to a project.

3.3 We apply an annual amount of 8% plus the Bank of England base rate on all overdue balances. Any payment you make first goes to paying off monthly service charges. Then it’s applied to the original unpaid balance. You’ll be responsible for all collection or legal fees resulting from late payment or failure to pay. Blue Ladder can end the contract if payment isn’t paid in full.

4. Working  arrangements

4.1 We’ll do our best to carry out work with minimal disruption to you. Likewise, we’ll need your help to make arrangements so that we can do our work as efficiently as possible. This means giving us free access for delivery of building materials and equipment, etc.

4.2 All building materials we provide will remain our property until we receive full payment. After payment you take ownership of only the materials used to carry out the work. Surplus and waste materials will remain our property.

4.3 We’ll be able to access and collect any building materials and equipment until we receive full payment.

4.4 We can’t take responsibility for any perished or rotten materials in existing structures, whether they were detected before or after you’ve accepted our quotation.

4.5 You are responsible for protecting existing surfaces from damage. But we always do our best to avoid these situations and use dust sheets and plastic sheeting, or other suitable materials. 

5. Changes

5.1 Any further work (services that aren’t included in the original scope of work) will come at an extra cost. The project timelines might need to change to accommodate these additional services.

5.2 Blue Ladder may give you a change order detailing the extra work you’ve requested. It’ll also include the amended timelines and additional costs. We won’t start on any work until you’re happy with the change order and have signed it. 

5.3 We value your time. We also value delivering high-quality work in the safest way possible. So we’ll always do our best to meet timelines set out in the quotation, whilst ensuring all safety measures are carefully followed.

5.4 If the project is delayed due to your late feedback or approval, you’ll be charged extra. Likewise, if any materials you’ve sourced for the build are delayed you’ll be charged extra (please see article 2.1.3). 

5.5 If you notify us of any delays in the project timeline we might slow or stop work. We’ll then contact you to create a new timeline that suits both of us. We’ll formalise this new schedule in writing. If you don’t respond or you keep the project on hold for longer than 10 business days, without prior notice and agreement, we may need to create a new quotation before continuing with the build.

6. Cancellations

6.1 Either you or Blue Ladder can end a contract at any time. Termination for convenience is immediately effective when notice is received. If we both agree to end the contract then this comes into effect immediately. And termination for cause is accepted if either of us:

6.1.1 becomes insolvent, files a petition in bankruptcy, makes an assignment for the benefit of our creditors; or

6.1.2 breaches these T&Cs and doesn’t resolve it within 10 days from receipt of written notice of the breach.

6.2 Blue Ladder will be compensated for any work we’ve carried out up to and including the date of termination. This compensation will be taken from any deposit you’ve paid, or a prorated portion of remaining fees due.

6.3 If you end a contract for convenience you agree to pay an early termination fee. This will be 10% of the total project costs. This fee will be used by Blue Ladder to cover our administrative costs. 

7. Confidentiality

7.1 When you work with us you can rest assured your personal details will remain confidential. We hold all client information in compliance with the UK and EU data protection legislation.

8. Warranties

8.1 Blue Ladder represents, warrants and covenants to you that we’ll provide the services listed in the quotation in a professional and workmanlike manner. This means we’ll work in line with all reasonable professional standards.

8.2 Aside from the warranty expressed in article 8.1, Blue Ladder doesn’t make any warranties whatsoever. And we explicitly disclaim any other warranty expressed or implied. This includes – but isn’t limited to – warranties of merchantability or fitness for a particular purpose or compliance with laws or government rules or regulations applicable to the project.

9. Liability

9.1 Blue Ladder can’t be liable to you, or any third party, for damages, liabilities, costs, losses or expenses which result from any claim, demand, or action by a third party if they are a result of you breaching your responsibilities or obligations, representations or warranties under these T&Cs.

9.2 Subject to these T&Cs, Blue Ladder agrees to not hold you liable for damages, liabilities, costs, losses or expenses which result from Blue Ladder breaching our representations or warranties under these T&Cs, except when any claims, damages, liabilities, costs, losses or expenses happen due to your gross negligence or misconduct.

9.3 Blue Ladder can’t be liable for any lost data or content, lost profits, business interruption or for any indirect, incidental, special, consequential, exemplary or punitive damages resulting from or relating to the materials or the services we provide.

9.4 In all circumstances, Blue Ladder’s maximum liability for damages to you is limited to our net profit.

10. Uncontrollable events

10.1 If we’re unable to complete part of or all the services you’ve hired us for due to circumstances beyond our control, we can’t be deemed in breach of these T&Cs. Circumstances beyond our control include – but aren’t limited to – natural disasters, fires, acts of war, terrorism, severe civil disturbances, death, illnesses, family emergencies and so on.

10.2  If any of these circumstances happen, we’ll let you know if we’re unable to carry out work, or if there will be a delay in the project as a result. We’ll offer a revised set of timelines to get the work finished.

11. Miscellaneous

11.1 Once we’ve finished the work we’ll take photos or videos to document that the scope of work has been fully completed. Unless you ask us not to, we may use the photos and videos on our website and other promotional materials. We’re proud of the work we do for our clients, and we like to showcase our talents to prospective customers. However, we’ll take care to ensure that specific people, places and buildings cannot be identified in any images we use publicly. 

11.2 If any provision in these T&Cs are unlawful, void, or unenforceable then it’ll be deemed severable from the remaining provisions. It will not affect the validity and enforceability of the rest of these T&Cs.

11.3 These T&Cs are written and enforced exclusively under UK law. If there is any dispute about these T&Cs, then you and Blue Ladder agree to try and resolve it through negotiation.

11.4 This contract can’t be transferred to anyone else without Blue Ladder’s permission. This contract stays in place and doesn’t need to be renewed.

12.1 We have a separate privacy and cookie policies which cover use of the Blue Ladder website blueladderbuilding.com, and our use of data.
